January 2024, Los Angeles County. Defendant, driving a new Porsche SUV, pulled into traffic from a blind spot causing a head-on collision. Both vehicles were totaled, including the new Porsche. Admitted negligence. Plaintiff was in his 60’s with two prior fusion surgeries, but no known treatment for over a decade. Plaintiff immediately went to the ER with Headaches and neck pain. Plaintiff was diagnosed with a herniated disc and TBI. Plaintiff received injections and then a fusion surgery, as well as treatment for TBI. After 30 minutes of deliberation the jury returned a 12-0 defense verdict.
