September 2023, Kern County. Defendant was backing up a dump truck on a highway repaving job when he struck plaintiff. Plaintiff taken by ambulance to the hospital, later had multiple spinal injections, and a two-level laminectomy, formenectomy, discectomy and fusion. Was recommended for a Spinal Cord Stimulator, and blackboarded over $600,000 in past wage loss, and past and future medical bills. Asked for $4,600,000. Was offered $695,000. The jury awarded nothing after less than 45 minutes of deliberations.
