Alameda, November 2018, Defendant pulled out from a stop sign in front of motorcyclist plaintiff who had the right of way. Plaintiff was in a coma for more than a month and had more than $1,000,000 in medical bills for just the initial hospital stay. Plaintiff sustained significant life-long physical injuries (drop foot, loss of use of dominate hand) and a Traumatic Brain Injury making plaintiff, 30, unemployable for the rest of his life. Defendant’s own doctors found plaintiff completely disabled for life. Claimed $16,000,000 in medical bills, life care and lost wages. The case was bifurcated. As to liability, the Fremont police found the defendant 100% at fault and found that plaintiff was riding his motorcycle at approximately the speed limit before the impact. Oakland jury found the plaintiff 95% at fault. There was no trial as to damages.
